The decisions suggest that the battle over using a wartime law, the Alien Enemies Act, to deport migrants is certain to persist.

Judges in Texas and New York have temporarily barred the U.S. government from deporting Venezuelans jailed in parts of those two states while their lawyers challenge the Trump administration’s use of a rarely invoked law letting presidents imprison and deport noncitizens in times of war.

The hearing concerned a suit filed late Tuesday on behalf of two Venezuelan men facing imminent deportation to a Salvadoran mega-prison without a chance to refute allegations they are gang members.
